The results of CAPS cases for Tuesday 4/9/02
1202 N. 19th St., Bennie & Annie Miles
11 charges nolle prose against Ms. Miles due to medical reasons. An
attempt was made to try the case against Mr. Miles on all charges but against
the City's argument, the Judge continued the case to 7/4 in order to give Mr.
Miles time to demolish.
500 W. Brookland Park Bvd. Donald Neal, Street Action Auto
Judge Smith found Mr. Neal guilty on both charges but deferred the
sentencing to Judge Robertson. The case was set for sentencing on May 21.
The results of CAPS cases for Wednesday 4/10/02
3901 Jefferson Davis Hwy, Mr. Taylor
Judge Rupe found Mr. Taylor guilty on all charges and sentenced him as
follows:
1) 2 prop. maintenance violations re: interior surfaces and foundation walls,
$100 fine on each
2) 1 prop. maintenance violation re: heating system, $500 fine with $400
suspended and court order to repair within 90 days
3) 18.2-319 violation re: illegal storage of refrigerators, $250 fine
4) 1 zoning violation re: outside storage of scrap materials, $1500 fine with
$1400 suspended and court order to abate within 2 weeks

Subject: 4-8-02 CAPS Court Update
The following is the report from assistant city attorney Alicia Zatcoff on
the results of CAPS cases during the week March 22-27. Please note that some
cases were continued and citizens are needed on those dates as well.
General District Court
501 North 9th Street
Public Safety Building (Lower Level)
City v. Richmond Enterprises, Inc., Paul Spears, President. 107 S. Colonial
Street. Defendant's property had 7 building code violations due to the
deteriorated nature of the structure. I appeared on 3/26 and the court found
the defendant guilty on all charges. The sentence was a $100 fine on each
count and $100 restitution to CAPS on each count for a total of $1,400.00 in
fines and restitution. The court ordered that the violations shall be abated
within 45 days.
City v. Clifton Taylor. 2617 Wise Street.
This case had been continued from Feb. on defendant's request. Defendants'
property had 10 building code violations due to the dilapidated nature of the
structure. I appeared on 3/27 and the court found the defendant guilty on all
charges. The sentence was a $50 fine on each charge for a total of $500. The
property has been demolished.
City v. Brock Summs. 642 W. Southside Plaza.
The defendant was charged with 4 building code violations and 2 zoning
violations. The defendant owns and operates Summs Recovery & Collection, Inc.
(this company was a former city-towing contractor). I appeared on 3/27 and the
defendant was found guilty on all charges. The sentence was a $100 fine on
each of the building code violations and a $2,500 fine with $2,000 suspended
and 30 days in jail with 30 days suspended for 2 years on each of the zoning
violations, for a total of $1,400 in fines and 60 days suspended jail time.
The court also ordered the defendant to remove all junk and inoperable
vehicles within 90 days.
City v. Vernell and Rene Cooper. 3008 Q Street.
Vernell Cooper is the property owner and Rene Cooper is her son. They were
charged with a zoning violation for operating an illegal auto repair business
on the property. I appeared on 3/26 and discovered that Vernell Cooper had
Alzheimer's so her case was nolle prose. I proceeded to try the case against
Rene Cooper and he was found guilty. The sentence was a $500 fine, $100
restitution to CAPS, 30 days in jail with 30 days suspended for 3 years and a
court order to cease any auto repair business for pay on the property.
City v. Moorefield. 1607 Hickory Street.
Defendant's property has multiple building code violations. I appeared on 2/12
and the defendant retained an attorney. The case was continued until 3/26. I
appeared on 3/26 and the case was continued until 4/30.
City v. Kenneth Glidewell. 214-224 Jefferson Davis Highway.
The defendant owns and operates Glidewell's, an illegal auto repair and junk
storage business. Forest Holding Co owns the property. The defendant is
charged with 9 fire code violations, 2 building code violations and 2 zoning
violations. I appeared on 3/27 and the defendant requested a continuance to
retain an attorney. The defendant was ordered to return to court on 4/3 to
receive a trial date.
City v. Bennie and Annie Miles. 1202 N. 19th Street.
The defendants own the property and are each charged with 11 building code
violations due to the deteriorated nature of the structure. I appeared on 3/26
and neither defendant appeared in court. The court issued a capias for Mr.
Miles and a show cause for Mrs. Miles for 4/9.
City v. Gabriel Taylor. 3901 Jefferson Davis Highway.
The defendant owns the property and was charged with 3 building code
violations and 1 zoning violation due to the deteriorated nature of the
structure and outside storage of scrap materials. I appeared on 3/27 and the
defendant requested a continuance. The case was continued to 4/10.
